1. Agreement to Terms

This document constitutes a legally binding agreement ("Terms") between you ("you" or "User") and Zion Market ("the Store," "we," "us," or "our") concerning your use of the online store located at https://shop.zionmarket.com (the "Service"). The e-commerce technology platform for this Service is provided by Superstorefront Inc., a third-party service provider.

By creating an account or using this Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the Service.

2. User Accounts

Eligibility: You must be at least 18 years of age to create an account and place orders.

Account Creation: You agree to provide accurate, current, and complete information during registration, including your full name, email address, and phone number.

Account Security: Access to your account is secured via a One-Time Password (OTP). You are solely responsible for maintaining the security of the device and accounts used to receive these OTPs and for all activities that occur under your account.

3. Orders, Payment, and Fulfillment

Product Information: We strive for accuracy but do not guarantee that product descriptions, pricing, or availability are complete or error-free.

Order Acceptance: Your placement of an order is an offer to purchase. While you will receive an initial email acknowledging receipt of your order, this does not constitute a final acceptance. We reserve the right to adjust or reject any order for any reason. The order is officially accepted, and a contract of sale is formed, only when the Store physically begins to prepare your order.

Payment: You authorize us and our third-party payment processor to charge your selected payment method for the total amount of your order, including all applicable taxes, delivery fees, and tips.

Pickup Services

In-Store Pickup: If you select pickup, you are responsible for retrieving your order within the specified timeframe. If an order is not picked up by the end of the business day on its scheduled date, it may be canceled by the Store. You may be charged a restocking fee, and no refunds will be issued for perishable items.

Delivery Services

Third-Party Couriers: Delivery services are performed by third-party independent contractors ("Couriers") (e.g., Uber Direct). By selecting delivery, you acknowledge that these Couriers are not employees of the Store. We are not liable for the conduct, negligence, or omissions of these Couriers.

Delivery Estimates: Delivery windows are estimates only. Actual arrival times may vary due to traffic, weather, and Courier availability.

Unattended Delivery & Risk of Loss: You may select "Leave at Door" or "Meet at Door" during checkout.
IF YOU SELECT "MEET AT DOOR" AND ARE NOT AVAILABLE: You explicitly authorize the Courier to leave the order at your doorstep unattended in the event they cannot reach you.
TRANSFER OF RISK: Regardless of the delivery method selected or used, you agree that all risk of loss, theft, damage, or spoilage transfers to you immediately upon the Courier’s delivery to the designated address (as confirmed by the Courier's delivery record or photo). We are not responsible for the quality or safety of perishable items left unattended after delivery.

Failed Deliveries & Refunds: Delivery fees and Courier tips are non-refundable under any circumstances, including if the delivery is late or if you are not available to receive it. If an order cannot be delivered due to incorrect address information provided by you, or if it is left unattended and subsequently stolen or spoiled, you remain responsible for the full cost of the order. At the Store's sole discretion, we may issue a refund or credit for non-perishable items if they are recovered in saleable condition.

Data Sharing: By placing a delivery order, you consent to the sharing of your necessary personal information (name, delivery address, phone number) with our third-party delivery partners solely for the purpose of fulfilling your order.

Substitutions: You agree that we may contact you to discuss potential substitutions for out-of-stock items.

Cancellations: Once submitted, an order is considered final. To request a cancellation, you must contact the Store directly. Such requests are not guaranteed.

4. User Conduct

You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to, engaging in fraudulent activity, interfering with the Service's security, or using automated systems to scrape data.

5. Intellectual Property

All content on the Service, including logos, text, graphics, and the underlying software platform, is the property of the Store or its licensors (including Superstorefront Inc.) and is protected by intellectual property laws.

6. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any reason, including a breach of these Terms. You may close your account by contacting us.

7. Disclaimers and Limitation of Liability

Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE STORE AND SUPERSTOREFRONT INC. EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE STORE OR SUPERSTOREFRONT INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THE TOTAL LIABILITY OF THE STORE AND SUPERSTOREFRONT INC. FOR ANY CLAIM ARISING FROM THE USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO THE STORE FOR THE ORDER GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless the Store and Superstorefront Inc. from any claims, liabilities, damages, and costs (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

9. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by the laws of the State of CA, without regard to its conflict of law principles.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration in San Diego, CA, rather than in court. The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

Small Claims Court Exception: Notwithstanding the above, either you or the Store may choose to pursue a dispute in Small Claims Court instead of arbitration, provided the dispute falls within the jurisdiction of that court and proceeds on an individual (non-class) basis.

Class Action Waiver: YOU AND THE STORE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Severability: If any part of this arbitration agreement is found to be unenforceable or unlawful (including, for example, a waiver of the right to seek public injunctive relief), then that specific part shall be severed, and the remainder of the agreement shall continue in full force and effect. If a claim cannot be arbitrated, it shall be brought in court after the arbitration of all arbitrable claims is complete.

10. Tax Exemption

By submitting a tax exemption certificate, you represent that it is valid and that you are authorized to submit it. The merchant is responsible for verification. Fraudulent submissions may result in account termination.

11. General Provisions
